Airtym is operated by Loose Inc, a Delaware corporation doing business as Airtym (“Airtym”, “we”, “us”, or “our”), located at 8 Circle Dr, Rensselaer, New York 12144, United States. This Privacy Policy explains how we collect, use, share, and protect personal information when you use our website, platform, and related services (the “Services”).

2. Information We Collect

We collect information you provide directly to us, such as when you create an account, book a session, or contact us for support. This may include:

  • Personal information (name, email address, phone number)
  • Profile information (bio, expertise, availability)
  • Payment information (processed securely through third-party payment providers such as Stripe; we do not store full card numbers)
  • Communication data (messages, and — where a session is recorded — session recordings, transcripts, and AI-generated summaries and notes)
  • Usage and device information collected automatically (IP address, browser type, pages viewed, and similar analytics data)

Where sessions are recorded or transcribed, participants are notified within the Services. Service Providers are responsible for obtaining any consent to recording required by the laws applicable to their clients.

3. How We Use Your Information

We use the information we collect to:

  • Provide, maintain, and improve our Services
  • Process transactions and send related information
  • Generate session summaries, notes, and post-call automations you request
  • Send technical notices, updates, security alerts, and support messages
  • Respond to your comments and questions
  • Monitor and analyze trends and usage
  • With your consent, or as otherwise permitted by applicable law, send you newsletters, product updates, and marketing communications (see Section 5)

4. Legal Bases for Processing

Where the law of your jurisdiction requires a legal basis for processing personal information (for example, in the European Economic Area or the United Kingdom), we rely on: (a) performance of a contract, to provide the Services you sign up for; (b) legitimate interests, such as securing and improving the Services and communicating with existing customers where permitted; (c) consent, for marketing communications and any optional features that require it, which you may withdraw at any time; and (d) legal obligation, where we must retain or disclose information to comply with law.

5. Marketing Communications and Your Choices

With your consent, or as otherwise permitted by applicable law (including Canada’s Anti-Spam Legislation and the US CAN-SPAM Act), we may send you newsletters, product updates, and marketing communications about the Services.

Every marketing email we send will identify Loose Inc (dba Airtym), include our mailing address, and contain a working unsubscribe link. You may withdraw your consent or unsubscribe at any time using that link or by emailing support@airtym.com, and we will honor your request promptly and within the timeframes required by applicable law.

Withdrawing consent to marketing does not affect service-related or transactional communications (such as receipts, booking confirmations, security notices, and account messages), which we send as necessary to operate the Services. Creating an account or accepting our Terms of Service does not by itself constitute consent to receive marketing messages.

6. Information Sharing

We do not sell your personal information. We do not trade or otherwise transfer your personal information to third parties without your consent, except as described in this policy:

  • With service providers who assist us in operating our platform (such as cloud hosting, video infrastructure, payment processing, email delivery, transcription, and analytics providers), under contracts that limit their use of your information to providing services to us
  • Between participants of a session as necessary to deliver the Services (for example, sharing a booking confirmation, session link, or session summary with the other participant)
  • When required by law, legal process, or to protect our rights, safety, or property, or those of others
  • In connection with a business transfer, merger, financing, or acquisition, in which case we will require the recipient to honor this policy or notify you of any material change

7. International Data Transfers

We are based in the United States and process personal information on servers located in the United States and other countries where our service providers operate. If you use the Services from outside the United States, your information will be transferred to, stored, and processed in the United States, where data protection laws may differ from those of your jurisdiction. Where required by applicable law, we rely on appropriate safeguards for such transfers, such as standard contractual clauses with our service providers. 8. Data Retention

We retain personal information for as long as your account is active or as needed to provide the Services, and afterwards only as long as necessary to comply with legal, tax, and accounting obligations, resolve disputes, and enforce our agreements. Session recordings, transcripts, and summaries are retained according to the settings available in the Services and are deleted when you delete them or your account, subject to backup cycles and legal retention requirements.

9. Data Security

We implement appropriate technical and organizational security measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the internet or method of electronic storage is 100% secure, and we cannot guarantee absolute security.

10. Your Rights

Depending on your jurisdiction, you have the right to:

  • Access and update your personal information
  • Delete your account and associated data
  • Opt out of marketing communications at any time
  • Request a copy of your data in a portable format
  • Object to or request restriction of certain processing
  • Withdraw consent where processing is based on consent, without affecting processing carried out before withdrawal

11. Users in Canada

If you are in Canada, we process your personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws, including Quebec’s Act respecting the protection of personal information in the private sector (Law 25). You have the right to access and correct your personal information, to withdraw consent subject to legal and contractual restrictions, and to complain to the Office of the Privacy Commissioner of Canada or, in Quebec, the Commission d’accès à l’information. Your information may be processed outside Canada, including in the United States, and may be subject to the laws of those jurisdictions.

12. Users in the EEA, UK, and Switzerland

If you are in the European Economic Area, the United Kingdom, or Switzerland, the legal bases described in Section 4 apply to our processing of your personal information. In addition to the rights listed in Section 10, you have the right to lodge a complaint with your local data protection supervisory authority. Where we transfer your personal information outside your region, we do so subject to appropriate safeguards as described in Section 7.

13. Children's Privacy

The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will delete it promptly.
